Distance Sales Contract

1. PARTIES

This Contract is concluded between the parties below under the terms and conditions stated herein.

By accepting this Contract, the BUYER acknowledges in advance that, upon confirming the order subject to this Contract, the BUYER will be obliged to pay the order amount and any additional charges such as shipping and taxes (if any), and that the BUYER has been informed in this regard.

2. DEFINITIONS

In the application and interpretation of this Contract, the terms below shall mean the explanations stated next to them:

MINISTER: The Minister of Customs and Trade,
MINISTRY: The Ministry of Customs and Trade,
LAW: Law No. 6502 on the Protection of Consumers,
REGULATION: Regulation on Distance Contracts,
SERVICE: Any consumer transaction other than supplying goods, performed or undertaken to be performed for a fee or benefit,
SELLER: The company that offers goods to the consumer within the scope of its commercial or professional activities or that acts on behalf of or for the account of the entity offering goods,
BUYER: The natural or legal person who acquires, uses, or benefits from a good or service for non-commercial or non-professional purposes,
SITE: The website of the SELLER,
ORDERING PARTY: The natural or legal person requesting a good or service through the SELLER’s website,
PARTIES: The SELLER and the BUYER,
CONTRACT: This contract concluded between the SELLER and the BUYER,
GOODS: Movable goods subject to shopping and intangible goods such as software, audio, video, etc. prepared for use in electronic form.

3. SUBJECT

This Contract governs the rights and obligations of the parties under Law No. 6502 and the Regulation on Distance Contracts regarding the sale and delivery of the product(s) ordered by the BUYER electronically via the SELLER’s website, the characteristics and sale price of which are stated below.

The prices listed and announced on the Site are sale prices. Announced prices and offers remain valid until updated or changed. Time-limited prices remain valid until the end of the stated period.

7. INFORMATION ON THE PRODUCT(S) SUBJECT TO THE CONTRACT

7.1. The main characteristics of the goods/product(s) (type, quantity, brand/model, color, quantity/pieces) are published on the SELLER’s website. If a campaign is organized by the Seller, you may review the main characteristics of the relevant product during the campaign period. It remains valid until the campaign date.

7.2. Prices
The prices listed and announced on the Site are sale prices. Announced prices and offers remain valid until updated or changed. Time-limited prices remain valid until the end of the stated period.

7.3. Taxes and Payments
The total sale price of the goods or services subject to this Contract, including all taxes, is calculated based on the “Order Summary” formed at the time of ordering and is presented to the buyer at order confirmation.

Note: The order line items and total amounts are included in the order confirmation e-mail and/or the order record.

9. GENERAL PROVISIONS

9.1. Information and Acceptance
The BUYER acknowledges, declares, and undertakes that the BUYER has read and is informed about the basic characteristics of the product subject to the Contract, the sale price, the payment method, and the preliminary information regarding delivery on the SELLER’s website, and has given the required confirmation electronically.

9.2. Delivery Period
Each product subject to the Contract shall be delivered within the period specified in the preliminary information section on the website, depending on the distance of the BUYER’s place of residence, provided that it does not exceed the legal period of 30 days.

10. RIGHT OF WITHDRAWAL

If the distance contract relates to the sale of goods, the BUYER may exercise the right of withdrawal within 14 days from the date of delivery of the product to the BUYER or to the person/institution at the address indicated, by notifying the SELLER, without giving any reason and without any penalty.

11. GOODS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED

Products prepared in line with the BUYER’s request or clearly personal needs, and products such as underwear bottoms, cosmetic products, single-use products, etc. are excluded from the scope of the right of withdrawal.

12. DEFAULT AND LEGAL CONSEQUENCES

If the BUYER makes payments by credit card and falls into default, the BUYER acknowledges, declares, and undertakes that the BUYER will pay interest within the framework of the credit card agreement with the cardholder bank and will be liable to the bank.

13. COMPETENT COURT

In disputes arising from this Contract, complaints and objections may be made to the consumer arbitration committee or consumer court located in the place where the consumer resides or where the consumer transaction is carried out.

14. EFFECTIVE DATE

When the BUYER completes the payment for the order placed through the Site, the BUYER shall be deemed to have accepted all terms of this Contract.
